Changes to the employer’s tip credit for tipped employees is a hot topic in the hospitality industry as businesses look for ways to maintain compliance and avoid hefty penalties, while keeping labor costs in check.

The U.S. Department of Labor’s Final Rule amends the Fair Labor Standards Act (FLSA) for tipped employees to clarify that an employer may take a tip credit only when an employee is performing work that is part of a tipped occupation and defined it as work that produces tips or directly supports work that produces tips, provided that the directly supporting work is not performed for a “substantial amount of time.” What this means for employers is that they must pay tipped employees the full minimum wage, rather than the tipped wage, when directly supporting work exceeds 20 percent of workweek hours, or a consecutive period of time exceeding 30 minutes. This has hospitality operators reviewing the time tipped employees spend on side work tasks, including dining room and station prep, silverware polishing and rolling, and glass polishing.
